These Terms of Service ("Terms") govern your use of the Upkeep app ("Upkeep", "the app"), published by [Company name — to be finalized] ("we", "us", "our"). By downloading or using Upkeep, you agree to these Terms. If you do not agree, do not use the app.
Upkeep is a personal vehicle-maintenance tracking app. It helps you record vehicles, maintenance schedules, service history, fuel economy, and documents, and reminds you when service is due. All of your data is stored locally on your device; the app has no accounts and no backend service (see our Privacy Policy).
We grant you a personal, non-exclusive, non-transferable, revocable license to use Upkeep on Apple devices that you own or control, for your personal, non-commercial use, in accordance with these Terms and Apple's App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by applicable law.
Upkeep's schedules, due-date calculations, and reminders are informational estimates based on the intervals and mileage you enter. They are a convenience and not a substitute for your vehicle manufacturer's official maintenance schedule or the advice of a qualified mechanic.
You are solely responsible for the actual maintenance and safe operation of your vehicle. We are not liable for missed service, vehicle damage, or any consequence arising from reliance on the app's reminders or calculations.
The optional recall-check feature retrieves data from the U.S. National Highway Traffic Safety Administration (NHTSA) public API. This information is provided by NHTSA "as is." We do not control, verify, or guarantee its accuracy, completeness, or timeliness. Always confirm recall and safety information with the vehicle manufacturer, an authorized dealer, or NHTSA directly. Absence of a listed recall in the app does not mean none exists.
Fuel-economy and spending figures are calculated from the entries you provide and are estimates for your own tracking. They are not certified measurements and should not be relied upon for tax, regulatory, resale, or warranty purposes.
When you use the recall-check feature, your request is sent to NHTSA, whose services are governed by their own terms and policies. We are not responsible for third-party services.
Upkeep is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any defects will be corrected.
To the maximum extent permitted by law, [Company name — to be finalized] and its members, officers, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, vehicle damage, or costs, arising out of or related to your use of (or inability to use) Upkeep. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the app will not exceed the greater of (a) the amount you paid for the app, or (b) USD $5.
We may update Upkeep and these Terms from time to time. Material changes to these Terms will be reflected by updating the effective date above and, where appropriate, noted in the app or its App Store release notes. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
You may stop using Upkeep at any time by deleting it. These Terms remain in effect with respect to your prior use. The sections that by their nature should survive termination (including Sections 3, 4, 8, 9, and 12) will survive.
These Terms are governed by the laws of the state in which [Company name — to be finalized] is organized, without regard to its conflict-of-laws rules, except where applicable consumer-protection law requires otherwise.
